Please read these Terms of Use carefully before purchasing. By purchasing, you agree to be bound by these terms.
Hey there! By purchasing any digital products and/or courses mentioned on this website (hereinafter the “Program”), you, the purchaser (hereinafter “Student”), enter into an agreement with Nimisha Kantharia (“Company”) and agree to the following terms:
1. Course Deliverables
The Program is an online course. Company agrees to provide the content as promised on the Program checkout page, which may include:
- Video teachings
- Presentation slides/handouts
- Transcripts
- Additional notes
- Workbooks/Journals
- Guided audios and/or meditations
Student will retain access to the Program for the life of the Program, meaning for as long as the Company offers and maintains the Program. Company will provide Student with at least one month’s notice should it need to retire the Program. It is the Student’s responsibility to download all materials before the retirement date.
2. Privacy Policy
The Company’s Privacy Policy is incorporated by reference into this agreement. Student understands that Company’s obligations under this Agreement exist only while Student is a paying member of the Program. Company’s obligations cease once Student or Company cancels Student’s membership. This Program does not include 1:1 support unless explicitly stated.
3. Payment
In consideration of access to the Program, Student agrees to pay the price stated on the sales page or promotional offer at the time of purchase. Student authorizes the Company to charge their payment method automatically as part of any payment plan.
4. No Refunds
All sales are final. The Company has a strict no-refund policy for digital products and online programs. Student acknowledges and agrees to this policy at the time of purchase.
5. Cancellation
Student may not cancel payments once enrolled and is responsible for full payment. If payment is missed, the Company may revoke access and pursue collection if needed. Company may cancel access at any time, for any reason.
6. No Resell or PLR Rights
This Program does not grant Master Resell Rights or Private Label Rights. Student agrees not to reproduce, redistribute, or create derivative works from Program content.
7. Intellectual Property
All content provided (text, audio, video, PDFs, designs, etc.) remains the intellectual property of the Company. Student is granted a non-exclusive, non-transferable, single-user license to access the material for personal use only.
8. Force Majeure
The Company is not responsible for delays or failures caused by events beyond its control (natural disasters, strikes, pandemics, government actions, etc.).
9. Independent Contractor
Nothing in this Agreement forms a partnership, employment, or agency relationship. The Program provides educational content only and does not constitute professional advice or services.
10. Severability
If any provision of this Agreement is found to be invalid, the remainder shall remain enforceable and in effect.
11. Liability
Student releases the Company from all liability for any damages resulting from the use of this Program. Use of the content is at Student’s own risk.
12. Medical Disclaimer
The Program is not a substitute for medical, psychological, or therapeutic care. Participation does not create a doctor-patient, therapist-client, or coach-client relationship.
13. Warranty
All content is provided “as is.” The Company makes no warranties, express or implied, including merchantability or fitness for a particular purpose.
14. Assignment
Student may not assign or transfer this Agreement without written permission from the Company.
15. Modification
Company may update these terms at any time. Updated terms will be posted on https://mariposamatriarchy.com, and purchasers will be notified.
16. Indemnification
Student agrees to indemnify and hold harmless the Company from any claims, losses, or legal fees arising from their use of the Program or breach of these terms.
17. Dispute Resolution
Any disputes will be handled in the small claims courts of Maharashtra, India. Student waives any other jurisdiction.
Indian Refund & Cancellation Policy (Consumer Protection Compliance)
In accordance with the Consumer Protection Act, 2019 and Indian e-commerce guidelines:
- Digital Products (courses, audios, PDFs, recordings): Non-refundable due to instant access.
- Live 1:1 Sessions: Fully refundable if cancelled at least 48 hours in advance.
- Live Group Events: Non-refundable if a replay is provided. If no replay is offered, cancellations up to 48 hours before are eligible for a full refund.
- Memberships/Subscriptions: Can be cancelled anytime to stop future billing. No refunds for past payments.
- Money-Back Guarantees: If offered, will be clearly stated on the product’s sales page.
